Terms and Conditions, disclaimer for advice services

Scope of Engagement

By engaging Baby and Car (the “Service Provider”), the client (“You” or “Client”) agrees to the provision of personalised car advice and support services which may include, without limitation:

  • Understanding your needs and lifestyle

  • Developing a personalised shortlist of suitable vehicles

  • Research support including pricing, deals, and car availability

  • Assistance in organising test drives

  • Guidance around finance, trade-ins, insurance, or novated leasing

  • General car purchasing support up to and including decision day

  • Capsule and car seat education and/or installation booking

  • Delivery day guidance and checklists

These services are strictly informational and advisory only. Baby and Car does not provide financial, legal, safety, mechanical, engineering, or investment advice. All purchase decisions remain solely with you. Baby and Car simply provides you the information to make an informed decision but is not responsible for the final decision made.

Payments, Cancellations & Rescheduling

  • All services are payable up-front to secure your consultation.

  • If you cancel before the service has commenced, a full refund will be issued.

  • If you wish to reschedule, you may move your session once within 28 days of the original booking, to a new date within 12 months, subject to availability.

  • If you cancel after the service has commenced, or fail to reschedule within the allowed timeframe, no refund is payable as the work will have been commenced and time allocated.

No Guarantees

Baby and Car does not guarantee:

  • The availability, price, or delivery of any vehicle.

  • That our research reflects the most recent information held by dealers, brands, or third parties.

  • Any outcomes regarding finance approval or insurance acceptance.

All final results, decisions and transactions with third parties remain your sole responsibility.Changes to Policies

We may update our policies from time to time. We will notify you of any changes via email. Please review our policies periodically for updates.

Limitation of Liability

To the maximum extent permitted by law:

  • Baby and Car, Jade Nicola Credentino, and associated contractors disclaim all liability for any loss, damage, cost, or expense (including incidental, consequential, or special damages) arising from or in connection with your use of our services.

  • All opinions are general in nature and you agree to rely on your own judgment and carry out your own due diligence before making any purchasing decisions.

  • In all cases, you expressly agree that Baby and Car’s total cumulative liability, if any, shall not exceed the total amount paid by you for the relevant service, and that you will not pursue any claim beyond this.

Errors & Omissions

While every effort is made to ensure information shared is accurate and up to date, no responsibility or liability is accepted for any errors, omissions or changes in third-party information (including pricing, vehicle specifications, wait times, and available features).

Privacy & Confidentiality

  • Baby and Car collects personal information about your household, lifestyle, vehicle needs and contact details purely to perform the service.

  • Your data is stored securely and is not shared with any third party except where required to facilitate bookings or services at your written instruction.

  • Baby and Car may collect de-identified information for internal analytics or marketing purposes.

  • Both parties agree to keep commercially or personally sensitive information confidential.

Intellectual Property

All checklists, templates, guides and materials provided remain the exclusive intellectual property of Baby and Car. They are licensed to you for personal use only and may not be copied, shared, or used for commercial purposes.

Force Majeure

Baby and Car shall not be liable for any delay or failure to perform the Services where such delay or failure results from causes beyond its reasonable control, including but not limited to acts of God, natural disaster, pandemic, illness, injury, telecommunications or power failure, war, terrorism, or government restriction. In such circumstances, Baby and Car will use reasonable efforts to resume Services as soon as practicable or offer a rescheduled booking where appropriate.

Client Responsibility Clause

You agree to provide timely, complete and accurate information as reasonably required for Baby and Car to perform the Services. Baby and Car shall not be liable for any delay, recommendation, comparison or outcome which is impacted by your failure to provide such information or to act on guidance in a timely manner.

Dispute Resolution

If a dispute arises, both parties will attempt to resolve the matter in good faith. If resolution cannot be reached, the parties agree to attend mediation in Victoria before commencing legal proceedings.

Jurisdiction

These Terms are governed by the laws of Victoria, Australia. You submit irrevocably to the exclusive jurisdiction of Victorian courts.

Third-Party Disclaimer

Baby and Car makes introductions or referrals to third-party providers only and does not accept responsibility for any representation, advice, service, warranty, conduct or product supplied by any such third party. Any relationship entered into between you and a third-party provider is entirely at your own risk, and you release Baby and Car from all liability regarding third-party interactions.

Termination Clause

Baby and Car reserves the right to immediately terminate the Services (without refund) where the Client behaves in a manner that is abusive, threatening, unlawful, or in breach of these Terms & Conditions; or otherwise engages in conduct that, in the reasonable opinion of Baby and Car, damages its reputation, staff wellbeing, or operational capacity. Upon such termination, all outstanding fees shall remain payable.

Acceptance

By paying the invoice, making a booking, or otherwise engaging our services, you acknowledge that you have read, understood and agreed to be bound by these Terms & Conditions.
